West Kirby Public Spaces Protection Order
Wirral Council is calling for public input on a proposed Public Spaces Protection Order (PSPO) that would significantly extend coverage across West Kirby and parts of Hoylake.
PSPOs, established under the Anti-Social Behaviour, Crime and Policing Act 2014, grant local authorities and police the authority to address anti-social behaviour (ASB) in specific areas. These orders target behaviours that negatively impact local communities, thus protecting residents and maintaining public order.
The current PSPO, implemented in September 2020 and extended until 3 September 2024, covers West Kirby Beach and Cubbins Green. This measure has effectively curtailed anti-social behaviour in these areas, showcasing the necessity and efficacy of such orders.
However, with the existing PSPO approaching its expiration, Wirral Council has reviewed the situation and identified ongoing issues. Reports indicate that individuals committing ASB often disguise their identities and operate in large groups, exacerbating the problem.
In response, Wirral Council proposes a new, expanded PSPO encompassing a larger area of West Kirby and part of Hoylake. This strategic move aims to bolster public safety and curb the rise of anti-social activities, ensuring that residents and visitors can enjoy these areas without fear of disruption or harm.
The Council urges all stakeholders to review the proposed boundaries of the new PSPO, as illustrated in the map below, and participate in the consultation process to help shape the future of community safety in these regions.

Proposed West Kirby Public Spaces Protection Order (PSPO)

1. Gathering Restrictions: Any person in a group of four or more in the restricted area must disperse if instructed by a Police Officer or an authorised officer. This instruction is based on a reasonable belief that someone in the group is engaging or intending to engage in behaviour likely to cause alarm, harassment, or distress. Officers must inform the individual that non-compliance without reasonable excuse is an offence and provide evidence of their authority if requested.
2. Re-entry Prohibition: Individuals instructed to leave the restricted area must not return within 24 hours without a reasonable excuse.
3. Face Coverings: No person shall wear anything covering any part of their face in open public spaces within the restricted area, except for face coverings worn for religious or health reasons, or as required by law.
Violating the PSPO terms can result in a fine up to £1,000 upon prosecution. Alternatively, authorised officers may issue a Fixed Penalty Notice of £100 if deemed appropriate.
